These general conditions of sale apply strictly to all sales of products made by the BODEGA TORRECASTILLO, S.L online shop. Any order placed with the BODEGA TORRECASTILLO, S.L online shop necessarily implies, as an essential, determining and essential condition, the unreserved acceptance by the Client of the General Conditions of Sale of the BODEGA TORRECASTILLO, S.L online shop in force on the day on which the corresponding order is placed. Furthermore, the Client acknowledges that acceptance of these conditions shall imply their application to the order to which they refer, as well as to any subsequent order, with the exception of those cases in which new conditions are brought to their attention by the BODEGA TORRECASTILLO, S.L. online shop. The fact that the BODEGA TORRECASTILLO, S.L. online shop does not have recourse to any of these conditions at any given time shall not be interpreted or construed as a waiver or recourse to them in the future or in the past.
The interpretation and execution of the conditions, as well as all acts that are a consequence of them, shall be subject to Spanish law, unless there are public policy provisions to the contrary.

On the other hand, the user, registered on the website and whose purpose is to be a consumer and/or user of the same and/or contract the products or services of BODEGA TORRECASTILLO, S.L . The consumer and/or user is responsible for the data provided to BODEGA TORRECASTILLO, S.L. and is therefore responsible for the veracity of the data provided on this website.
The prices published in the BODEGA TORRECASTILLO, S.L. online shop are in Euros. All prices include the VAT applicable on the day of the order, any change in the VAT rate will be automatically applied to the prices of the products on sale in the BODEGA TORRECASTILLO, S.L. online shop.
Offers on products on sale in the BODEGA TORRECASTILLO, S.L. online shop will be shown in the “Offers” section or indicated in the product details and, unless otherwise indicated, will be valid for as long as they are displayed on the screen.
The discount vouchers will have a validity period and special conditions for their use. Please consult the specifications of each voucher before using it.
PURPOSE OF THE CONTRACT (DESCRIPTION OF PRODUCTS AND SERVICES)
The contractual relationship of purchase and sale will involve the delivery of a product(s) in exchange for a price determined on the website.
When placing the order, the customer may freely choose to pay for purchases made in the BODEGA TORRECASTILLO, S.L. online shop by:
- Cash on delivery, applying a supplement of 3€ for each order placed; which will be added to the total of the invoice, included in the final amount to be paid.
- By credit or debit card through the virtual POS. Through this means of payment, the buyer will have to provide their card number, expiry date and CVV number. In this case, your data will be encrypted and sent under a secure server to the bank’s virtual POS. This procedure does not provide BODEGA TORRECASTILLO, S.L. with your card number.
- Through the paypal.com platform payment service
The offers presented by the BODEGA TORRECASTILLO, S.L. online shop are valid within the limit of available stock and the dates established for said offer. The BODEGA TORRECASTILLO, S.L. online shop reserves the right to modify the range of products according to the difficulties imposed by its suppliers.
In the event that the selected product is not available in stock, on the product page the user will be able to provide their email address so that the company can contact the user once the product is available by email.
SHIPMENTS AND RETURNS
The delivery time is 48 working hours approx. Deliveries are only made from Monday to Friday. All our items are sent by express courier with 24/48h service.
Orders are prepared as soon as the payment has been confirmed and within the following timetable:
Monday to Friday from 9:00 to 18:00 h. Orders received outside these hours will be prepared the next working day.
In the case of international shipments the delivery time is approx. 7 working days.
Important: due to the current situation resulting from Covid, delivery times may be altered at certain times. In any case, this responsibility does not fall on Bodega TorreCastillo, S.L., as the orders will be sent in the time and manner mentioned above.
- The products purchased will be delivered to the address indicated in the order.
- The purchase invoice will be sent to the address indicated by the customer when registering in the BODEGA TORRECASTILLO, S.L. online shop and may also be consulted in the registration account created by the customer in the BODEGA TORRECASTILLO, S.L. online shop.
- On Saturdays, Sundays and public holidays there will be no delivery of orders.
- If delivery is made on these days, it will be made punctually under the responsibility of the carrier.
- An order is considered delivered when the carrier delivers the package or packages to the customer and the customer signs the delivery receipt document. It is the customer’s responsibility to check the condition of the goods on receipt and to indicate any anomalies on the delivery note.
Claims for undelivered orders
If the consumer and/or user, after receiving an e-mail confirming that their order has been dispatched, and after a period of 7 days has elapsed without receiving the product, they can contact BODEGA TORRECASTILLO, S.L. via the contact form or by e-mail: email@example.com in order to clarify the cause of the delay.
Once the complaint has been received, BODEGA TORRECASTILLO, S.L. will contact the consumer and/or user in order to explain what happened and reach an agreement on what happened.
In the event that BODEGA TORRECASTILLO, S.L does not have availability of the product purchased, the consumer and/or user will be informed of this lack of availability and will receive the sums paid from BODEGA TORRECASTILLO, S.L as soon as possible.
If, once the purchase has been made, you wish to cancel an order that has not yet been dispatched, you can do so as long as you indicate this using the contact form established for this purpose in the “contact” section or by writing to the e-mail address firstname.lastname@example.org, indicating the number of the order you wish to cancel.
Return of defective products:
The consumer and/or user will have a period of 5 calendar days from the date of receipt of the product to return it, ONLY AND EXCLUSIVELY if:
- the quantity of the products does not correspond to the quantity ordered.
- the box has been seriously damaged in a way that affects the quality of the products, in which case you must inform the carrier and state this on the delivery note.
- if the products received do not correspond to the order placed.
Without prejudice to any other rights that may correspond to him/her, the Customer shall be entitled to reimbursement of the price of the defective products or of the products delivered if they do not correspond to the order placed by the user. Alternatively to the foregoing, the User shall be entitled to claim, and be delivered, a product equal to that ordered, in perfect condition.
In the event of return to BODEGA TORRECASTILLO, S.L , of defective products or products that do not correspond to the order placed, the return must be made by the customer using the procedure established in the following section, although the customer, in this case, shall not be liable for the cost of returning the said products.
Provided that the user has followed the procedure established in the returns procedure section and the requirements established in this section have been met, BODEGA TORRECASTILLO, S.L , will refund the price paid for returned products that are defective or do not correspond to the product order placed by the customer.
The product must be in the same condition in which it was delivered and must retain its original packaging and labelling.
The return to BODEGA TORRECASTILLO, S.L. must be made using the same box used in the delivery, or, failing that, in a similar format that guarantees the return of the products in perfect condition (except in the case of bottles of wine served in wooden boxes, which can only be returned in the same unopened box).
To exercise your right of withdrawal, it is not sufficient to send the product physically, but you must inform us that you are exercising your right of withdrawal by sending an e-mail to email@example.com.

In case of withdrawal, the refund will include all shipping costs paid by the customer when making the purchase. However, BODEGA TORRECASTILLO, S.L. may charge additional shipping costs in the case of a non-standard shipping method or urgent delivery.
In any case, it will be the customer, in the event of cancellation, who will pay the costs of returning the products to BODEGA TORRECASTILLO, S.L.
To browse the shop and add products to the shopping cart you do not need to be registered. However, to make a purchase you will need to register as a guest user. If you wish to receive a nominative invoice, the system will ask you for your personal data to generate your customer file. This data will be protected in accordance with the provisions of Law 15/1999, of 13 December, on the Protection of Personal Data.
